SPECIAL EDUCATION and
RELATED SERVICES

Dismissal from special education and related services or removal of a student from special education programs is the responsibility of the IEP Team. A school must evaluate a student with a disability (Guidelines under "Re-evaluation") before determining that the student is no longer a student with a disability in need of special services. An evaluation is not required before a student graduates with a regular diploma or upon reaching the age of 22.

Termination of special education and related services occurs through the initiation and completion of the eligibility process (i.e. component checklist [Form 30.03], notification of re-evaluation [30.04], parental permission secured [30.06], eligibility meeting documented and parental signature secured for termination of services [50.02]). If the Eligibility Team determines the student is no longer eligible as a student with a disability who needs special education and related services AND if parental concent is secured, the student is exited from special education and the services terminated.

A student with the special education classification of Speech and Language Impairment must go through the eligibility process prior to termination of special education services. A student who receives speech services as a related service without the classification of "SLI" may have services terminated in the context of an IEP meeting.

A student who receives speech, occupational therapy, physical therapy, or vision services as a related service, may have those services terminated in the context of an IEP Team Meeting with parental consent. The IEP Team must include the school personnel representing the related services discipline in person, by telephone, or by some other electronic means. Consent must be secured prior to the termination of related services that si reflected in an IEP document.
