When a school building administrator or designee
reports a crime committed by a student with a disability,
the school official will contact the parent(s) of the student,
in a timely fashion, and inform them of the action to be
taken. The school official will ask the parent for permission
to transmit the student's most current IEP and discipline
records to the agency the crime was reported and concurrently
discuss the reasons behind the transfer of records. If permission
is granted, records should be transmitted. In the event
permission is not granted, the school official should document
in the student's scholastic record the incident and due
to the requirements of the Family Rights and Privacy Act
(FERPA), the transmission of records could not be carried
out.
